Terms and conditions of use of the Robozin AI platform

1. Introduction

Welcome to ROBOZIN AI (“Platform”, “ROBOZIN”, “we” or “our”), a service that offers integrated solutions for communication and transactions between independent service providers (“Professionals”) and consumers (“Customers”) through WhatsApp and/or similar apps. These Terms of Use (“Terms”) govern access to and use of the Platform, available at www.robozin.ai. By accessing or using the Platform, the User agrees to comply with these Terms. If you do not agree, do not use the Platform, do not sign up and do not submit any data. Questions: contato@robozin.ai.

The FAQ pages and the Privacy Policy of ROBOZIN are integral parts of these Terms. By accepting them, you also agree to those provisions, which must be read together with this document.

While using ROBOZIN, personal data will be collected and processed by ROBOZIN and partners, as described in the Privacy Policy.

ROBOZIN is provided by Bozin Tecnologia Ltda, Brazilian tax ID (CNPJ) 53.879.715/0001-22, headquartered at Alameda Princesa Izabel, 291, AP 1006, 80430-120 Curitiba, PR, Brazil.

2. Definitions

1. Platform: Online system with features such as automated scheduling, quote generation and other tools described in these Terms.
2. User: Any person who uses the Platform, as a Professional or Customer.
3. Professional: Independent professional who uses the Platform to offer services.
4. Customer: Individual or legal entity who hires services from Professionals through the Platform.
5. Robozin: Automated interface that makes the interaction between Users and the Platform easier via WhatsApp.

3. Services, prices and payments

ROBOZIN offers different plans:

1. Basic plan (free)

Offered free of charge to Professionals, with limited access to Platform features.

2. Premium plans (subscription)

Full access to all features, without the limitations of the basic plan. Current options include quarterly and annual subscriptions.

The premium plan includes broad access to features, including a personalized website, smart agenda, quote/invoice/receipt generation and digital signatures, dedicated human support, priority on quotes and requests, benefits such as site promotion (eligibility-based) and custom domain (eligibility-based), as the platform evolves.

Payment methods

Subscriptions can be paid by credit card, bank slip (boleto) or Pix, according to the options available at the time of purchase.

Recurring billing

On credit card, billing may be automatic for the contracted period (monthly, quarterly or annual) until cancellation. On boleto or Pix, access depends on payment confirmation within the stated deadline.

ROBOZIN may revise prices with at least 30 days’ advance notice. The User may cancel before the new prices take effect if they do not agree.

The Provider may cancel the subscription in the account settings or via support. Cancellation takes effect at the end of the contracted cycle; access remains until then. There is no proportional refund for the remaining period after cancellation.

4. Eligibility and sign-up

• The User must be at least 18 years old and have full legal capacity.
• Sign-up requires truthful, complete and up-to-date information. ROBOZIN may suspend or terminate accounts with false or outdated data.
• Cancellation can be requested through support channels or at contato@robozin.ai.

When canceling, access to the Platform and related services may be interrupted after the request is processed. The User acknowledges that:

1. Service termination: Ongoing services may be terminated.
2. Data loss: There may be loss of access to data, documents, history, reviews and reports — the User should save anything needed before cancellation.
3. Pending charges: Cancellation does not release accumulated financial obligations up to the cancellation date.

• ROBOZIN may cancel accounts in case of violation of these Terms, improper or unlawful use, or other justified circumstances.
• Cancellation may also occur due to conduct harmful to ROBOZIN’s reputation, including unlawful, unethical or negative media exposure that poses a risk to the company’s image.
• ROBOZIN may run background checks when necessary for safety; refusal or identified risk may lead to account termination.
• The User will be notified of cancellation, except when serious conduct (law, fraud, immediate risk) justifies omitting notification.

5. User obligations and responsibilities

• Use of the Platform in accordance with the law and these Terms. Unlawful, fraudulent or third-party-rights-violating use is prohibited, under penalty of removal and legal action.
• User-generated content (reviews, messages, profile) must be lawful and truthful. The Platform may remove inappropriate content.
• The User is responsible for account and password security. The Platform is not liable for losses caused by unauthorized access.

6. Limitation of liability

• ROBOZIN is not responsible for acts or omissions of Users (Professionals or Customers), including service delivery failures or rights violations. Interactions and transactions are between Users; ROBOZIN does not guarantee quality, safety or legality of services.
• Links to third parties are not controlled by ROBOZIN, which is not responsible for content, policies or practices of those services.
• ROBOZIN aims for continuous availability but does not guarantee uninterrupted or error-free access and may suspend or discontinue services.
• The Platform is provided “as is”, without express or implied warranties, including merchantability, fitness for a particular purpose or non-infringement.

THE USER AGREES TO INDEMNIFY AND HOLD ROBOZIN HARMLESS FROM ANY LIABILITY, COST, EXPENSE OR DAMAGE (INCLUDING LEGAL FEES) ARISING FROM CLAIMS RELATED TO MISUSE OF THE PLATFORM, VIOLATION OF THESE TERMS OR INFRINGEMENT OF LAW OR THIRD-PARTY RIGHTS.

IN NO EVENT SHALL ROBOZIN BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, BUSINESS INTERRUPTION OR OTHER LOSSES RELATED TO THE USE OR INABILITY TO USE THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Intellectual property

ROBOZIN may offer creation of logos, banners and advertising materials. When requesting such materials, the User agrees that:

1. Rights over materials created by ROBOZIN remain with it until full payment of the service (which may or may not be part of the plan), per the contract.
2. After full payment, ROBOZIN transfers to the User the right to exclusive commercial use, in compliance with the law; ROBOZIN may retain a copy for internal and promotional purposes.
3. Resale, sublicensing or redistribution to third parties is forbidden without ROBOZIN’s express written consent.
4. Use in violation of these terms may result in legal action and damages compensation.
5. ROBOZIN may include credits or signatures in created materials, as long as they do not interfere with the User’s commercial use.

8. Privacy and data protection

• Personal data processing follows the Privacy Policy, an integral part of these Terms.
• The Platform adopts appropriate security measures without guaranteeing absolute security and is not liable for unauthorized access outside its reasonable control.
• Users may exercise the rights provided by the Brazilian LGPD as described in the Privacy Policy.

9. Changes to the terms

ROBOZIN may modify these Terms at any time, notifying via the Platform or other appropriate means. Continued use after changes implies acceptance of the revised Terms.

10. Applicable law and jurisdiction

These Terms are governed by the laws of Brazil. Disputes will be resolved in the Court of the Judicial District of Curitiba, PR, to the exclusion of any other, except for consumer claims as permitted by law.
